The Fire Department NOC is provided by the particular states' fire service that verifies that the building can perceive any fire-related accidents or the building is fire resistant. The fire department issues No Objection Certificate for the commercial and residential commercial structure built by applicant. The instructions for obtaining NOC may vary as per to the different states.

Multi-storey buildings that have a height of more than 15 meters must get Fire NOC on an obligatory basis from fire department of respective states.

Regulations governing Fire Department NOC in India

The set of regulations governing Fire Department NOC in India are covered under the 12th Schedule of the Constitution of India, which comes under the scope of the various municipality departments.

The fire and associated activities are governed by the state governments under the Municipal By-Laws or State Regulations. Before the implementation of a new Act, it was governed by the Delhi Fire Prevention and Fire Safety Act, 1986.

Documents required for obtaining Fire Department NOC

The application for both offline and online application must be attached with the following documents-

  • Building plan which consists of Building Layout Plan, including a layout plan, building model and site plan.
  • Certificate of Building model and Building stability.
  • A duly certified Checklist by a qualified Architect.
  • Identity and Address Proof of the Applicant.
  • Photograph of the building.
  • Certificate of completion for electrical wiring.

Procedure for obtaining Fire Department NOC

Following are the steps to obtain NOC from the fire department in India:

  • The applicant can file an online application through the official website of the respective state by submitting the application form to the fire service department or Chief Fire Officer for acquiring a clearance certificate.

 

  • Following are the necessary documents that must be attached:
    • A copy of the building plan layout provided by building authority
    • Certified checklist of the building
    • Building model
    • Copy of PAN and Aadhar of the applicant
    • Photograph of the building
    • Certificate issued by a recognized authority verifying the quality of electric wiring.
  • After receiving the application for NOC, Chief Fire Officer forwards the application to the concerned supervisor who has the jurisdiction in the relevant state.
  • The supervisor will visit the site and inspect all the necessary equipment that are installed in the building along with the safety arrangement needed for safety in case of fire.
  • The supervisor of the concerned state will provide the fire clearance certificate after duly examining the building with all the fire safety arrangements, and when the supervisor is satisfied with the safety arrangements operational in the building.
  • After the NOC is issued, validity
    • For residential buildings is five years &
    • For commercial buildings is three years.

Types of No Objection Certificate issued by Fire Department

Following are the types of NOCs issued by the fire department:

  • Provisional Certificate

After the evaluation of fire safety measures is done by the supervisor, the fire department suggests an applicant to install specific fire safety mechanisms. The fire department issues a Provisional No Objection Certificate.

Provisional No Objection Certificate is a fire safety certificate temporarily issued by the department, in regard to the compliance made by the applicant according to the recommendation made to him/her. Provisional No Objection Certificate has validity for a definite period in which the applicant has to plan to comply with the recommendations.

  • Final NOC

An applicant has to apply to the fire prevention authority to examine the implementations. After examination, the administration will test and attest that the applicant is following the given recommendations, and all equipments are functioning in pleasing condition.

It is essential to note that the applicant has hold on to the guidance essential for obtaining the Fire NOC.

On finding the equipments are working in adequate conditions, the fire department will Issue a Final NOC, which is valid for one year from the date of issue. It should be renewed every year by applying to the Fire Department.

One must obtain Fire department NOC to avoid loss or damages to life and property.
