The main objective of this act is to protect the interest of the customers in the Real Estate Sector. RERA promotes standardization and transparency in the business activities conducted in the Real Estate Sector. RERA works rigorously to protect the interest of both the promoters and buyers by imposing strict and specific duties on both of them and tries to ascertain symmetry of information between promoter and buyer. It works as a guard to protect customers from gluttonous builders and it also provides a platform known as RERA Complaint to the customers. Homebuyers are capable of filing a complaint against the agent, builder or developer under RERA complaint if they feel they are being cheated or if any provision of the RERA Act is infringed.

The home buyers have the right to file a complaint in case of any scam, fraud or any unhealthy business practice against them. Now, the home buyers in the real estate sector have the right to file a grievance and complaint and in return, the buyers can expect a satisfied solution to the problem.

To resolve their problems buyers can ask RERA authorities to arbitrate in their matter. Although, it is the duty of the home buyer to corroborate that their builder is registered under RERA. If in the case the builder of the real estate project is not registered under the RERA, buyers of such housing projects may find themselves in an impasse and may encounter difficulties in filing a complaint against the builder.

RERA Complaint Regarding the Projects

As per the provisions of RERA, 2016, it is essential for both the developers and the builders to get their real estate projects registered under the state regulatory authority of the concerned state. Real Estate Regulatory Authority provides a platform to the home buyers where they can check the growth and development of the on-going housing projects and can also file a complaint in case of any injustice. The home buyer can lodge a complaint in Form ‘A’ of Section 31 of the RERA Act to lodge a complaint against either the developer or the builder on experiencing any deceiving event. The home buyer has to ensure that the complaint has essential information present in it like registration number of the builder or developer projects.

If the Real Estate Regulatory Authorities fails to provide any solution to the home buyer then the buyer can seek the help of Appellate Tribunal within a period of 60 days of filling the RERA complaint.

RERA Complaint for Projects not Registered under RERA

There are builders and developers in India who have not registered their projects under RERA. Consequently, buyers of such real estate projects have to go through a lot of challenges while filing a complaint against the builders and developers. The home buyers who against their will got stuck with the unregistered real estate projects may seek legal solutions to get out of the problem. The buyers can ask for justice by filing criminal case or a file a complaint in the consumer court against the developer or builder of the unregistered real estate project. Furthermore, they can also appeal in the high court and demand a refund of their invested money.

There is still a ray of hope for the home buyers of unregistered property; both the government and the real estate regulatory authority are working in the direction to resolve the complaints of people who have invested in the unregistered real estate projects.
